RE: The tariff classification of an Outdoor Kitchen from China

Dear Ms. Williams:

In your letter dated November 14, 2007 you requested a tariff classification ruling. Descriptive literature along with an illustration was provided.

The item you plan to import is described as an Outdoor Kitchen, Item Number 07101392. This outdoor kitchen is made of steel and is fueled by propane gas. It is comprised of a stove top containing two burners and an oven for cooking or smoking. The product is for household use on the homeowner’s patio/deck or in the backyard and weighs 110 pounds.

The applicable subheading for the outdoor kitchen will be 7321.11.3000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other stoves or ranges for gas fuel or for both gas and other fuels. The rate of duty is free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
